These Terms & Conditions apply to the use of the LicenseCheck website and to verification services provided through or in connection with LicenseCheck. By using the website or submitting a verification request, you agree to these terms to the extent applicable.
1. About LicenseCheck
LicenseCheck is a specialist petroleum verification platform operated by the Fuel Wholesalers Association (Pty) Ltd under license. Its verification process is conducted separately from the counterparty being assessed. LicenseCheck is not a government department, petroleum licensing authority or regulator and does not issue, renew, approve or amend petroleum licenses or permits.
2. Verification Services
Verification services are performed according to the agreed scope and may include company/CIPC verification, petroleum license or permit checks, supplier verification, depot verification and selected supporting-document checks.
The exact scope, information required, turnaround and deliverable may differ according to the service requested and the information reasonably available.
3. Client Information
You are responsible for providing information that is accurate, complete and lawfully supplied. LicenseCheck may rely on identifying information and documents submitted by you when determining the verification scope and conducting checks.
LicenseCheck may request further information or clarification where the information supplied is incomplete, inconsistent or insufficient for the requested verification.
4. Verification Outcomes and Limitations
A verification outcome reflects the evidence and records reasonably available at the time of the review and within the agreed scope. Information, licenses, permits, company records and commercial relationships can change after a verification is completed.
Verification does not constitute a guarantee of legality, solvency, future conduct, product quality, contractual performance or regulatory compliance beyond the matters specifically verified.
An outcome stating that information could not be verified does not necessarily mean the information is false; it means sufficient evidence was not available to independently confirm it within the applicable scope.
5. Third-Party and Official Sources
LicenseCheck may use official records, regulatory information, company records, source documents and other third-party information. LicenseCheck cannot guarantee the continuous availability, completeness or accuracy of systems or records controlled by third parties.
6. Turnaround Times
Any stated turnaround is a target unless expressly agreed otherwise in writing. Completion may be affected by the verification scope, missing information, third-party response times, system availability or the need for additional clarification.
7. Verified Supplier Badges and References
A LicenseCheck badge or verification reference relates only to the verification record, date, scope and status to which it was issued. It may not be altered, misrepresented, transferred to another entity or used in a way that implies a broader or permanent guarantee.
LicenseCheck may withdraw, suspend or correct a badge or reference where misuse, material error, changed information or another valid reason is identified.
8. Intellectual Property
The LicenseCheck name, branding, methodology, website content, verification formats, badges and related intellectual property may not be copied, modified, republished or commercially exploited without permission, except for legitimate use of an authorised verification deliverable or badge in accordance with its terms.
9. Confidentiality and Privacy
Verification information is handled as confidential commercial information, subject to applicable law, the agreed service requirements and the LicenseCheck Privacy Policy. Information may be disclosed where reasonably necessary to perform the requested verification, comply with law or protect legitimate rights.
10. Website Information
Website and Knowledge Centre content is provided for general information and does not constitute legal, regulatory, financial, engineering or other professional advice. Requirements may change and should be confirmed for the specific circumstances with the relevant authority or professional adviser.
11. Limitation of Liability
To the extent permitted by law, LicenseCheck and the entity operating the service will not be liable for indirect, consequential or special loss arising solely from reliance on information outside the agreed verification scope, changes occurring after the verification date, inaccurate information supplied by third parties or decisions made without appropriate additional due diligence.
Nothing in these terms excludes liability that cannot lawfully be excluded or limits rights that apply under mandatory South African law.
12. Changes to These Terms
These terms may be updated from time to time. The version published on this website at the relevant time will apply to website use, subject to any separate written service agreement or quotation governing a specific verification.
13. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the applicable South African legal process, unless a separate written agreement provides otherwise.
